The Munich Court’s Reaction to the EC AMICUS BRIEF in Re HMD Global Oy vs VoiceAge EVS
In February 2025, the Munich Courts will release the judgment in ‘Re HMD Global Oy vs VoiceAge EVS’ concerning the alleged use of standard-essential patents (SEPs). In this matter the European Commission issued an Amicus curiae to the Higher Court of Munich, Germany, (Oberlandesgericht Muenchen). Such an instrument is rather untypical in Europe and underlines how important standard essential patents are to the European policy maker. In this webinar we will discuss how and to what extent the judicial authorities in Munich have reflected the E.C.’s Amicus Brief in their judgment. Further questions to debate about will be if and to what extent the case will be referred on to the Court of Justice of the European Union. Overall, we expect the case to offer further insights on the future of SEP licensing in Europe.

Clemens-August Heusch is Vice President at Nokia and heads the Global Litigation and Disputes Team. He is responsible for litigation, arbitration and mediation globally with a strong focus on multinational IP litigation and licensing (FRAND) arbitrations. Since 2008 Nokia has been involved in more than 200 patent cases worldwide against companies such as Apple, HTC, Blackberry, InterDigital, Qualcomm, Daimler, Intellectual Ventures, IPCom, KPN, Daimler, Lenovo, Oppo, Vivo, Amazon, HP and others. Those patent cases related to implementation patents as well as to SEPs relating to GSM, UMTS, LTE, H.264, WiFi, NFC and others.

Senior Legal Director, Head of IP Policy
Le Chen is currently the senior director for dispute resolution and head of IP policy Europe at Xiaomi, mainly responsible for standard-essential patent related matters. Previously Le was a senior IP counsel at ABB Schweiz AG, where he was a reference expert in the IP field related to digital innovation and standardisation and led frequently patent licensing and IP benchmarking activities in the furtherance of ABB’s digital innovations. Before ABB, he worked at a renowned German IP law firm .
