Economic Impact of Linking to Third Party Content

Is embedding third party content subject to copyright? As the Court was in the process of determining what digital subject matter copyright actually entailed, OxFirst was requested to assess the economic impact of the judgment.

Our Approach

We studied how much the potential change in law would cost the average European citizen. We found that the average European citizen would have to give up nearly 10% of her net income if embedding third part content were to be subject to copyright.

Impact

The CJEU ruled that embedding third party content is not subject to copyright. The study caught also the attention of the European Commission and was reflected in one of the Public consultation rounds launched by the E.C.
